Mcleodganj – Mini Tibet of India

0
Mcleodganj

Mcleodganj is the one-stop destination for those who yearn to visit hillsides. This is one of the most attractive tourist sights which fulfils to promise the scintillating views of the mountains. It is situated on the outskirts of Dharamshala, in Kangra town of Himachal Pradesh.  In Mcleodganj is located, His Holiness the Dalai Lama’s Main Temple.

If you are fortunate, you might also be able to listen to the teachings and preachings of Dalai Lama who visits it much often every year. There are a large number of Tibetan monks that can be seen preaching and praying inside the temple. People can either take quite long peaceful walks with family during the evening or the more adventurous ones can also opt for trekking and other fun-filled activities. I had never witnessed snow, so watching squall was my foremost preference. It was a sudden plan with the friends of the college and we quickly reserved our seats and found ourselves vacationing during the republic day holidays.

How to Reach Mcleodganj?

Flights are available till Gaggal Airport that is the nearest airport to Mcleodganj. From there you could avail cabs or shuttles. We as college kids went for a more frugal ride and chose a semi-sleeper Volvo bus from Majnu Ka Tila, Delhi to Mcleodganj. It was a 13 hours-long but cosy ride. We reached Mcleodganj by 12 pm and directly headed to Hotel Anand Palace, located in Bhagsunag. The staff was really kind and jovial. We did not dine in the hotel and headed out. We had sour supper at the famous German Bakery restaurant. Their hash potatoes were something to die for.

Places to visit in Mcleodganj :

1. The Tibetan Market

Apart from the Dalai Lama Temple, there is one of the major attractions that tourists love the most. It is the Tibetan Market. The market was filled with Tibetan gift items, potteries and what not. It seemed a bit tad too expensive but a little bargain helped us buy a lot of items. The items were so delicate and beautiful. We bought a lot of articles from there. Statues of Buddha, singing bowls, dream catchers, cushion covers, bohemian jewelry, colourful clutches and mandala paintings were some of the gifts we bought for our family and friends. After a full day at the trek, it was indeed a peaceful experience.

2. Kangra Fort

The fort is located on the outskirts of the Kangra Valley. It is often described by many people as one of the best forts in India.  Its architecture goes thousands of years behind. It was an impromptu plan to visit this place as the staff of the hotel suggested we go there once. We were so happy seeing what the fort stored for us. There were many statues of various lords. We could spot some families asking their children to pray to the gods there. The entrance was beautifully built and we loved every part of being there. 3. Naddi View Point

For people who want a peaceful time away from the bustling streets of  Mcleodganj, Nandi ViewPoint is the one-stop destination for them. We met a lot of people who live in that village. It was fascinating to know about their day to day lives. They told us about how many foreigners come to meditate there to attain peace while glimpsing at the Dhauladhar Ranges located at a distance. If at any time, the temperatures start dropping down, the villagers offer cosy home stays at their place. I was awestruck by the serendipity of the place. I wanted to stay there more but one of my friends caught a cold so we had to go back to our hotel.

4. Triund Trek

On our second day, after hearing a lot from our friends, we decided to go on the famous Triund Trek. Triund is the centre of attraction of the scenic Dhauladhar Range. The trek was somewhere between easy to moderate levels of difficulty. We started from Dharamkot and passed alongside the famous Guna Devi Temple where we prayed and paid our obeisance. The people were too helpful. They kept on offering me and my friend’s food and water. We stopped at various Maggi points to have little breaks and enjoyed our magi and tea there. It is one of the most beautiful trek destinations of Mcleodganj

We came through several little streams and ponds. It took us almost two days to reach till the top. It was exhausting and tiring. We were all weary. But the view we witnessed after reaching the top was worth it all. It was so calming and beautiful. We have had our camp set up there. We stayed there for one night. It was a night full of dances, songs and making friends. We left from Triund the next day with a heavy heart and full of warm feelings.

5. Bir Billing

It was one of the most adventurous parts of our trip. I had never been that close to the sky. We visited this pretty place via travelling through a toy train. The mountains that were crossing our ways, the scenery and everything were so exhilarating. I was introduced to paragliding at Bir billing. It was an experience of the lifetime. We visited the Chokling Monastery, the Deer Park and the place where some of the refugees of Tibet still reside. It was a good experience all in all.

6. Bhagsu Waterfall

Bhagsu Waterfall is located on the way while coming down from the Triund Trek. We were all tired from the trek but one of my friends dearly wanted to go and pray at the Bhagsunag Temple. We reached the place and soaked our feet in the chilly water. One of my friends soaked her feet in haste that her socks got wet too. We had a hearty laugh over that. We had some warm tea and Maggi while watching the mighty waterfalls. There was a lot of crowd and the atmosphere was really nice. After a while, when we got hungry again we went to the nearby pretty café called-Namgyal Café. We had our lunch and then clicked some pictures and spent a happy day.

7. Dharamshala Cricket Stadium

Located in the middle of the Himalayan ranges, this stadium is one of the highest elevated stadiums in the world. People might think how weird it may be to visit a cricket stadium while visiting the hills but this stadium attracts a lot of tourists all around the year. The architecture of the stadium makes it a unique standout. It is built with modern style architecture infused with Tibetan era work. We were fortunate enough to witness the Cricket Team of Kings XI Punjab practising. It made a beautiful end to our trip. We boarded our buses back to our home towns and bid a goodbye to the beautiful land of Mcleodganj

Is Mcleodganj a budget-friendly travel spot?

Finally comes the most important question of the trip. The answer to all the students and kids would be a big YES. The travel expense can be broken into three parts.

Travel

We took a semi-sleeper Volvo bus from Majnu Ka Tila, New Delhi. The fare was around Rs. 850 per person. The return tickets from Mcleodganj to Majnu Ka Tila was around Rs. 900. You mostly have to walk in Mcleodganj. At one point from Nadi to Bhagsunag, we rented an auto for Rs. 20 per person. Apart from the travel expense was nothing more.

Lodging

Our trip was of 2 nights and 3 days. We rented two rooms. The room accommodation was Rs.1137 per day. The cost was distributed among two people. So it was a pretty economical stay at the Hotel Anand Palace.

 Food

We went to various cafes and bakeries. We ordered pasta, pancakes, doughnuts and a lot more. As surprising as it might sound but we had Maggi that was more expensive than the food at some restaurants. Food was much lower in cost than we had expected. Per person, food-budget was approximately Rs.400 per day.

All in all, it was a pretty budget-friendly and pocket-light trip. My overall expense of the trip was Rs 5500 for 3 days and I came back completely satisfied.

25 ways to overcome OCD – your self-help guide towards a calmer mind

ocd

Obsessive Compulsive Disorder or OCD is a mental condition, characterized by repeated thoughts and ideas that create a constant urge to perform a specific action. In simple words, an OCD brain would trick you into believing that you need to perform an irrational task in order to avoid disastrous consequences. For example, a number of people with OCD tend to wash their hands more often in order to avoid germs, for they think they might catch an incurable disease otherwise. OCD can take various forms; from people refraining from shaking hands to even getting into a habit of offering prayers 29 times a day, just to ensure that their family members don’t die.

It is important to note that most people follow certain rituals, like waking up early or brushing daily, but these do not necessarily qualify as obsessions. A habit takes the form of an OCD when its resistance leads to anxiety, and it starts interfering with the normal day-to-day activities of one’s life.

OCD tends to get worse with time, especially due to ignorance and lack of proper treatment. Severe cases of OCD often lead to patients becoming housebound in order to avoid compulsions. Moreover, OCD also paves the way for other mental health disorders such as anxiety, including social anxiety, separation anxiety, and panic disorder. People with OCD tend to be very embarrassed regarding their compulsive behaviours since these behaviours are often illogical. This embarrassment causes people to put great effort into hiding their disorder, giving it more time, which makes it worse.

While the exact causes of OCD remain unknown, they are supposed to be caused due to the following reasons:

  • genetic and hereditary factors
  • structural and functional abnormalities in the brain

Apart from these, OCD can also be a result of learned behaviours that turn repetitive to calm anxiety.

Common symptoms of OCD include:

  • Avoiding physical contact, in order to avoid contamination from germs.
  • Excessive perfectionism.
  • Blasphemous thoughts.

Common compulsions include:

  • Excessive washing of hands.
  • Repetitive checking of locks, gas appliances, electrical switches, and other devices concerned with safety and security.
  • Forming mental ideas of ‘good’ or ‘bad’ numbers and places.
  • Excessive praying.
  • Placing objects in a particular design of symmetry.
  • Touching objects a certain number of times, or moving them in a particular way.

Why does OCD need attention?

Shockingly, 1 in every 25 adults suffers from OCD, which makes up for approximately 2.2 million people from the total world population. The stigma associated with help regarding mental health often causes people to refrain from getting therapy. Moreover, many people suffering from OCD experience guilt and loneliness, which also prevents them from seeking medical help. Most people, thus, battle OCD alone, until the symptoms start turning severe. Very severe.

This article provides 25 measures that you can use in order to help yourself or someone you love.

1. Recognising and writing down patterns:

Keep a pen and a pad handy and try writing all your compulsive thoughts. Writing down repetitive behaviours urged by the brain helps in both identification and control of obsessions. Repetitive writing causes thoughts to lose power, as well as helps in keeping a check on the frequency of thoughts. Also, writing involves more effort than thinking, causing the thoughts to disappear sooner.

2. Fighting your fears:

As it is rightly said, the best way to conquer your fears is to face them. This technique of fighting your fears, known as the Exposure and Response Prevention (ERP) in medical terms, is proven to be one of the best ways of curing OCD. This process involves exposing oneself to thoughts or situations that trigger obsessive behaviour, and not responding to them. This technique was first tested in the 1960s by Victor Meyer on two of his patients suffering from a severe case of Obsessive Compulsive Disorder.

One of the patients was obsessed with cleaning while the other was haunted by blasphemous thoughts. The patients had not shown any signs of improvement with shock therapy, supportive therapy or medication. Just before they were made to undergo a surgery, Victor Meyer locked the former patient in a room full of dirt without allowing her to clean, while the other patient was purposely made to rehearse blasphemous thoughts without performing the rituals she otherwise would’ve performed. This treatment was the first to decrease the patients’ symptoms and has been in continuous practice for treating OCD since then.

3. Challenge to resist:

Another way of controlling thoughts is by recognizing and labeling them as ‘just thoughts’. Training the brain to understand that a call for a compulsive behavior is just a trick played by the hormones helps to have control over one’s action. Continuous resistance, eventually, in turn, helps in pushing the action out of habit. Having a belief that whatever worse could happen, will happen, gives the brain a sense of freedom that it is not in charge of all wrong.

4. Take risks:

Obsessive Compulsive Disorders, more often than not number of times, tend to affect the decision making abilities of the patient. In a study conducted by the US National Library of Medicine based on the “framing effect”, which investigates decision making based on whether monetarily equivalent choice options are framed in terms of a potential to either lose or gain, patients suffering from OCD were reported to be more indecisive and fell more often in the loss section. Taking risks challenges the brain and helps in providing more exposure, which in turn helps proper decision making.

5.Talking to friends:

hug

Most OCD patients are often shy in talking to a doctor or visiting therapy as they tend to suffer from a sense of constant guilt, which is worsened by the stigmas attached to mental health disorders. Having a conversation with your friends can help in getting rid of the emotional burden, without the fear of being judged. Moreover, talking about obsessions usually reveals behaviours or contexts that would’ve otherwise gone unnoticed. This further helps in having a better grip on your OCD.

6. Don’t strive for perfection:

Though being a perfectionist sounds like an all-time advantage, an obsession for perfection is a very common symptom in OCD patients. The strive for perfection takes a wrong turn when one starts having standards for excessive perfectionism, which are impossible to attain. Not being able to achieve these standards leads to a sense of negativity and sows seeds of feelings of worthlessness, all of which have negative impacts on the brain. This can be handled in two effective ways. By setting an attainable standard of perfection, and/or by accepting imperfections directly.

7. Refocus:

Refocusing works by drawing the attention away from one’s compulsive thoughts and focusing it somewhere else. For example, in case of a thought of compulsive praying, the focus can instantly be directed to the weather outside instead, thus drawing attention away from the obsessive thought. Refocusing takes time and is not the easiest method to practise, but it’s you winning at the end. The fifteen-minute rule, as proposed by Dr. Jeffrey Schwartz’s in his “Four steps towards beating OCD” involves the patient delaying the compulsive behaviour for fifteen minutes, before returning back to the urge. Any decrease in the desire to perform the ritual provides for motivation to wait for a longer period. The patient can start from a delay of five minutes and can extend it until the duration when the desire completely fades away.

8. Visualize:

The most common problem faced by people who suffer from OCD is that they continuously keep falling prey to their compulsive thoughts, in order to ease the anxiety. Self-help in this field involves the visualization of already having done the compulsive task. This is a technique of tricking your brain into thinking that you’ve already completed the compulsive task, whereas, in reality, you have not. For example, if one has a continuous urge to wash his hands, he can visualize already having washed his hands, which would trick his brain into not sending hand wash signals anymore.

9.Meditate:

Meditation, since times immemorial has been used to increase mindfulness. Meditation helps to treat OCD in two ways:

  • Obsessive Compulsive Disorders have scientifically been proven to affect the conscious area of the brain. Most mental disorders, including anxiety, depression, and OCD are a direct result of the conscious mind overload. Regular meditation helps in exercising control over the subconscious mind, which then helps in preventing negative thoughts, while also repaving the damages done by prior repetitive thoughts.
  • Boosting low levels of dopamine via artificial means has long been used in OCD treatments since the disorder has been noted to cause a decrease in dopamine levels. Meditation causes dopamine levels to increase naturally, helping OCD.

10. Get rid of old trauma:

OCDs can be caused due to a number of reasons. These might include biological, genetic, behavioural, cognitive or environmental causes. However, a number of times, OCDs are developed as a result of childhood trauma or past traumatic experiences. The Cognitive Behavioural Therapy (CBT) helps to treat OCD by understanding one’s history and analysing past experiences that could’ve led to the growth of compulsions. CBT is a short term therapy and helps the patient in changing his thought patterns. CBT is available online on a number of reliable platforms and can also be performed on one’s own by analysing past traumas and changing thought patterns related to the same.

11. Avoid alcohol and nicotine:

Cigarette smoking, alcohol and nicotine have shown to have detrimental effects on a majority of mental health issues, including anxiety, depression and OCD. The Diagnostic and Statistical Manual of Mental Disorders, Fourth Edition (DSM-IV) states that alcohol and nicotine can both cause dependence and can lead to an extension of OCD, causing other mental disorders such as depression and bipolar disorder. Avoiding alcohol, nicotine and added products can thus prevent the disorder from getting worse.

12. Exercise:

exercise

Exercising helps in releasing endorphins, which are natural stress busters. A study examining relations between aerobic exercise and OCD asked half of OCD patients undergoing therapy to go for a brisk run post their therapy sessions for a period of 12 days. The results showed a significant decrease in the OCD symptoms of the patients who exercised as compared to the ones who did not. Moreover, exercise also provides for a distraction from the compulsions and provides a healthier channel for your energy.

13. Sleep:

25 ways to overcome OCD – your self-help guide towards a calmer mind
Source: https://www.vectorstock.com

Repetitive thoughts while trying to sleep often result in distractions and it does not take long for it to turn into insomnia. Studies have shown that people going to bed late have less control over their OCD symptoms as compared to the ones who got proper sleep. OCD and sleep thus form a vicious cycle, as OCD causes lack of sleep, which in turn worsens the disorder. Listening to soft music to keep the mind distracted while trying to sleep helps in having proper sleep cycles, which eventually help in reducing symptoms of OCD.

14. Proper diet:

Messages are transferred between brain cells with the help of a neurotransmitter called serotonin. Serotonin, also known as the mood-influencer, is formed from the protein tryptophan and is a reported deficit in a majority of OCD patients. Consuming food rich in tryptophan thus helps in increasing serotonin levels, which helps in reducing OCD symptoms. Tryptophan is present in a variety of protein-rich foods such as turkey, chicken, milk, eggs, and cheese. It is also present in whole-grain foods, beans, and pumpkins. Sesame seeds, sunflower seeds, and nuts are also rich sources of tryptophan.

15. Manage stress:

Stress is not a cause of OCD but major OCD symptoms are triggered under situations of stress. Stress management can thus prove to be of great help in dealing with OCD symptoms. Relaxation techniques like meditation, yoga and even slow breathing help in calming the mind and managing stress better.

16. Get mad:

A large number of OCD patients get sudden rushes of rage, commonly termed as anger attacks. This anger is easy to understand as people suffering from untreated OCD do not only feel compelled to perform obsessive behavior to keep their anxiety calm but also are under the constant stress of not letting their tasks get hampered, as that feels equivalent to letting someone die. These anger attacks can often take a turn of violence, where the patient may try to physically hurt others. As scary as this might sound, small bursts of anger that do not run severely out of control have been proven to help OCD patients. Outbursts help in calming the mind, helping it relax.

17. Grounding:

Stress or panic attacks are common symptoms of OCD. In the case of such a scenario, the grounding techniques work wonders. These techniques usually follow a non-complex process to make one more mindful of one’s surroundings. Something as simple as having a bite of chocolate, and feeling the way it melts on your tongue, can be an effective method of grounding. Another method, called the 5 – 4- 3 – 2 – 1 technique of grounding involves acknowledging five things that you can see, four that you can touch, three things that you can hear, two that you can smell and one thing that you can taste around you. The process is followed by slow breathing and is by far the easiest most effective method of grounding to manage stress.

18. Healthy Channelizing:

Obsessive Compulsive Disorder patients have been shown to consume more than one hour per day practicing rituals in normal cases, whereas the time dedicated was increased to approximately three hours per day in severe cases of OCD. This energy can instead be channelized more productively in other tasks. Distracting the brain to focus on things other than the compulsions is one of the most effective ways of treating OCDs. It is easy to accomplish, and more importantly, is not accompanied by the urge to perform the compulsion later. While exercising provides for a great distraction along with physical benefits, you can also try giving more time to your hobbies, or visiting nearby places to channelize your energy more productively. Keeping yourself busy throughout the day would lessen the chances of your mind being attacked by compulsions.

19. Plan a vacation:

vacation
Source: https://www.travelandleisure.com

Going on a vacation is always fun, but it’s additionally beneficial in the case of OCD patients. A change from the normal surroundings breaks the usual thought patterns, thus lowering the frequency of performing compulsions. While some are able to completely let go of the previous thought patterns, the anxiety due to OCD in other patients sometimes tends to get worse. This again happens due to a disruption in usual thought patterns as the regular compulsions are not being performed. However, regular triggers help the brain, especially when they are least expected. A vacation thus, is a win-win in both cases.

20. Try self-help resources:

Self-help resources, just like this article, are guides that you can use to work on your OCD yourself. It is important to understand that self-help does not necessarily mean doing it all on your own. Mutual self-help groups or self-help online platforms are also effective in guiding self-care. Reading books on self-help is also an effective method that works in two ways: by serving as a source of distraction, as well as by providing the necessary self-help details.

21. Don’t Rush:

An understanding of the fact that OCD treatment can take time is necessary to not lose hope. A desire to recover immediately causes more stress, making the compulsions stronger. Pushing oneself over the limits will only lead to negative impacts and a worsening of the symptoms. A slow process, handling one compulsion at a time, works the best.

22. Maintain a Journal:

JOURNAL

Getting over OCDs is a long process and can often get tiring. A constant source of motivation and regular reminders of progress are therefore necessary in order to not lose track. Maintaining a journal with habit trackers does not only provide motivation but also helps in keeping a check on one’s compulsions. It thus becomes easier to spot warning signs and red flags when an obsession starts getting stronger. Ease your urges by getting a journal today!

23.Take Responsibility:

It is necessary to understand that mental disorders can only be well treated if one is willing to work on them on one’s own. Slow or no improvements during the initial days of therapy can often lead to distress and outbursts on friends, family, and even the therapist, but it is important to realize that therapy is just for help. The real work has to be done on one’s own part, and improvements will only be seen when you start trying yourself. Medicines and therapy can only help in making the process easier, but cannot cure the disorder.

24. Appreciate your efforts:

Acknowledging the hard work put towards a better version of oneself serves as another source of motivation to keep the brain going. Congratulate yourself every time you get over a compulsion, and treat yourself every time you are able to control your urge for a duration longer than the previous. After all, a little motivation goes a long way.

25.Keep trying:

Not losing hope is the key to OCD treatment. There occur numerous instances when patients give up to their compulsions, but what is more important to understand, is that it’s okay. You might fall, but you win every time you manage to get up. These instances of downfall are often demotivating, but it is important to not let it grow on you. Remember that every step you take leads you to a healthier tomorrow.

Self-help accompanied with regular therapy sessions, medications and homework exercises help in speeding up the recovery process. With the rising awareness regarding mental health diseases, OCD treatments are now available widely across the world. Obsessive Compulsive Disorder, like most other mental disorders, takes its time but can be cured completely with proper medication and self-help.

The Effect of Hindu Traditional Law on Statutory Law: Mitakshara and Dayabhaga – a detailed study

0
Hindu Law

Hindu law as a chronicled term, alludes to the code of laws connected to Hindus, Buddhists, Jains, and Sikhs in British India.

The Yajnavalkya Smriti is one of the numerous Dharma-related writings of Hinduism formed in Sanskrit. It is dated to between the third to fifth century CE and has a place with the Dharmasastras tradition. The content was created after the Manusmriti, yet like it and Naradasmriti, the content was made in shloka (beautiful meter) style. The lawful speculations inside the Yajnavalkya Smriti are introduced in three books, in particular, achara-kanda (traditions), vyavahara-kanda (legal process) and prayascitta-kanda (wrongdoing and discipline, penance).

The content is the “best made” and orderly example of this type, with substantial areas on legal process speculations, one which had a more prominent impact in medieval India’s legal practice than Manusmriti. It later wound up compelling in the investigations of the legitimate process in old and medieval India, amid the pilgrim British India, with the principal interpretation distributed in German in 1849. The content is remarkable for its disparities in lawful hypotheses from Manusmriti, for being more liberal and others conscious, and for broad exchanges on confirmation and sensibility of lawful documents.

There are two types of schools of Hindu law:

1.      MITAKSHARA school of Hindu law.

2.      DAYABHAGA school of Hindu law.

MITAKSHARA:

The Effect of Hindu Traditional Law on Statutory Law: Mitakshara and Dayabhaga - a detailed study

The Mitakshara is legitimate arrangements on legacy, composed by Vijnaneshwara a researcher in Western Chaiukya court in the twelfth century. It wound up one of most persuasive messages in Hindu law, and its standards with respect to property dissemination, property rights, and progression are still by and by crosswise over the vast majority of India aside from West Bengal and Assam where the Dayabhaga framework is rehearsed. A striking element is the guideline of division of genealogical property held by the Hindu joint family. The Mitakshara School exists all through India aside from in the State of West Bengal and Assam.

There are four Sub-Schools under  Mitakshara School:

i.          DRAVIDA SCHOOL (MADRAS SCHOOL).

ii.          MAHARASHTRA SCHOOL (BOMBAY SCHOOL).

iii.         BANARAS SCHOOL.

iv.        MITHILA SCHOOL.

DAYABHAGA

hindu act
Justice law legal concept

A Dayabhaga is a legitimate treatise managing different parts of Hindu law. It was composed by Jimutavahana and Hemadri and has much affected the Hindu common code of present-day India. ‘The arrangements identifying with property rights are followed in West Bengal and Assam. Not at all like the Mitakshara framework, the tribal property of the Hindu joint family can be apportioned among posterity for the most part after the dad’s demise, yet in uncommon conditions, the child has a privilege before the dad’s passing. Ideal to Stridhan is an outright right, the spouse having the privilege to offer, home loan or use without even the husband’s assent.

Also Read PROTECTION OF WOMEN UNDER INDIAN CONSTITUTION

Right of unmarried children and little girls over the Stridhan is perceived. The proprietor has supreme right of arranging property freely. Proprietorship is resolved by Shastras. It exists in West Bengal and Asam as it were. It has sub-school. it contrasts from Mistakshara School in numerous regards. Dayabhaga School depends on the code of Yagnavalkya remarked by Jimutvahana, Inheritance depends on the guideline of profound advantage. it emerges by pinda offering i.e. rice bali offering to expired progenitors. Sapinda connection is by pinda contributions. This has driven numerous researchers to infer that the Mitākṣarā speaks to the universal teaching of Hindu law, while the Dāyabhāga speaks to the changed variant.

This is in guide complexity to the Mitākṣharā, which gives the children a claim upon birth. Every sibling has responsibility for unequivocal part of the joint family property thus can exchange his offer. The dowager has a privilege to prevail to spouse’s offer and uphold parcel if there are no male relatives. On the passing of the spouse, the dowager turns into a coparcener with different siblings of the husband. She can uphold a segment of her offer.

Hindu Law

Both the Mitakshara & Dayabhaga laws became the basis for the Hindu Succession Act,1956.

Since no legal study is complete without a case study, here we have one for an understanding of the concepts discussed above.

CASE STUDY

Uttam vs Saubhag Singh & Ors

CIVIL APPEAL NO. 2360_of 2016

FACTS:

Plaintiff: UTTAM SINGH

Defendant: SAUBHAG SINGH

DISPUTE: Rights of ownership

SUBSEQUENT EVENTS: The appeal was by the plaintiff party who documented a suit for segment, being Suit No.5A of 1999 under the watchful eye of the Second Civil Judge, Class II Devas, Madhya Pradesh, dated 28.12.1998, in which the initial four respondents happened to be his father (litigant No.3), and his dad’s three siblings i.e. respondent Nos. 1,2 and 4. He guaranteed a 1/eighth offer in the suit property on the balance that the suit property was genealogical property, and that, being a coparcener, he had a privilege by birth in the said property as per the Mitakshara Law. A joint composed explanation was documented by each of the four siblings, including the offended party’s dad, asserting that the suit property was not offended party’s father had turned out to be independent. The preliminary court, by its request dated 20.12.2000 announced the offended party’s suit holding that it was conceded by DW.1 Mangilal that the property was in reality tribal property, and that, on the confirmation, there was no prior segment of the said property, as argued by the respondents in their composed proclamations.

ISSUES: In the above-mentioned case the contentious issue is whether the son has the capacity to inherit his father’s property him being the heir to it. The son (UTTAM SINGH) claimed to have a right in the ancestral property in accordance with the MITAKSHARA LAWS.

CASE JUDGEMENT

The study for the article has been derived from the supreme court judgment by Honorable  R.F Nariman and Honorable Kurion Joseph. This Court examined the legal position and ultimately approved of the view of 4 High Courts, namely, Allahabad, Madras, Madhya Pradesh, and Andhra Pradesh while stating that the Gujarat High Court’s view contrary to these High Courts, would not be correct in law. After setting out the various views of the five High Courts mentioned, this Court held:

“It is necessary to bear in mind the preamble to the Hindu Succession Act, 1956. The preamble states that it was an Act to amend and codify the law relating to intestate succession among Hindus.

In perspective of the introduction to the Act i.e. that to adjust where vital and to systematize the law, as we would like to think it isn’t conceivable when Schedule demonstrates beneficiaries in Class I and just incorporates child and does exclude’s child but rather includes child of a predeceased child, to state that when child acquires the property in the circumstance considered by Section 8 he accepts it as karta of his own unified family. The Gujarat High Court’s view noted above, if acknowledged, would imply that however the child of a predeceased child and not the child of a child who is planned to he avoided under Section 8 to acquire, the last would by applying the old Hindu law get a privilege by birth of the said property in spite of the plan laid out in Section 8. Moreover as confirmed by the Andhra Pradesh High Court that the Act makes it obvious by Section 4 that one should look to the Act if there should arise an occurrence of uncertainty and not to the prior Hindu law.

It is hard to hold today the property which lapsed on a Hindu under Section 8 of the Hindu Succession Act would be HUF in his grasp opposite his own particular child; that would add up to making two classes among the beneficiaries specified in Class I, the male beneficiaries in whose hands it will be joint Hindu family property and versus child and female beneficiaries regarding whom no such idea could be connected or mulled over. It might be said that beneficiaries in Class I of Schedule under Section 8 of the Act included dowager, mother, little girl of predeceased child and so forth.

Applying the law to the actualities of this case, obviously on the demise of Saubgh Singh in 1973, the joint family property which was familial property in the hands of Saubgh Singh and alternate coparceners, declined by progression under Section 8 of the Act. This being the situation, the genealogical property stopped to be joint family property on the date of death of saubgh Singh, and alternate coparceners and his dowager held the property as inhabitants in like manner and not as joint occupants. This being the situation, on the date of the introduction of the appealing party in 1977 the said hereditary property, not being joint family property, the suit for parcel of such property would not be viable. The interest is subsequently rejected with no request as to costs.

However since the father was a class I heir, the son’s appeal was not valid as the father was still alive, which made the plaintiff a Class 2 heir, since he was the son’s son.

CASE ANALYSIS

As stated previously, the Mitakshara laws form the foundation of the Hindu Succession Act, 1956. According to the guidelines laid down by the Hindu Succession Act, the property after the death of the owner gets transferred to the family members according to their class and relation with the deceased. The class 1 includes sons, daughters, widow, mother, son of a pre- deceased son, widows of a pre-deceased son, son of a, pre-deceased sons of a predeceased son, and widows of a pre-deceased son of a predeceased son.

The class 2 heirs are recognized in the following order –

  1. Father
  2. Son’s / daughter’s son
  3. Son’s / daughter’s daughter
  4. Brother
  5. Sister
  6. Daughter’s / son’s son
  7. Brother’s son
  8. Daughter’s / son’s daughter
  9. Daughter’s / daughter’s son
  10. Brother’s daughter
  11. Daughter’s /daughter’s daughter
  12. Sister’s son

In accordance with the above-mentioned information, we see that according to the Hindu Succession Act, the property will go to the class 1 heir. In the above-mentioned case, the father was still alive, who had obtained the property from his father. Hence, according to the law, the father, respondent Saubhag Singh was a class 1 heir. The son, however, confusing himself to be the class 1 heir demanded his right to the property. However, according to the law, a son’s son is a class 2 heir. When the rule was applied to this case, the son was declared to be a class 2 heir. Hence, he had no first claim to the property.

Inheritance Laws In other countries

In the U.S.A, the inheritance laws are different for different states. In most states and under most circumstances, the law puts forth an obligation to include the spouse in the will. States that follow a community property system have a provision according to which half the property of the deceased automatically belongs to the spouse.

For children, there exists no obligation as such and it is totally the discretion of the deceased whether to include the children in the will or not. According to the law, the intention to include a child in the will will be honoured when a new will is drawn up.

Since the topic of the study, i.e. Mitakshara and Dayabhaga law is primarily India, no cases exist in the Western or European law in relation with the topic.

Conclusion

In the above study, we found out about the basis of the Hindu Succession Act, 1956, the Mitakshara and the Dayabhaga laws. We found how the religious laws classify the heirs for the succession of property. We also saw under what conditions and in what circumstances the law provides the right of property to the heir of the owners of the property. We read about the underlying theory of the Mitakshara and the Dayabhaga laws and studied their sources. The alws were crafted in times of Brahmanical supremacy and the medieval period and hence, their constitutional adaptation is relatively more egalitarian as compared to the laws mentioned under original texts. The case we studied showed how the courts interpret the laws. The study makes it clear how the laws made for the inheritance of property function.

“Anyone can become a speaker, but not everyone can become a paid speaker.”- Brian Tracy

A professional public speaker

Regardless of whether this is an end (which means, you need to utilize it to help your career in another field), or on the other hand, as the ends itself, whereby you make public speaking a professional one, which aids you in generating your primary forms of income. Notwithstanding whether you need to do it exclusively as your primary source of income and career, or else you want to boost your career. The several queries I am going to cover today are going to enable you to do it.

Likewise, I have 5 of them. So moving along without any more goodbyes, we should make a plunge…

All right, the very first query will appear to be extremely self-evident, however, it is in reality quite noteworthy. Furthermore, that comes down to picking the principle area or general topic or forte that you need to have some expertise in…

How to pick your main topic?

Presently, there is somewhat of a line that you have to stroll between being specific that you scrap every other person. Thus expansive that you are not unreasonably fascinating or engaging, and you are nonexclusive. A case of this is simply being a nonexclusive initiative speaker. There is huge amounts of them out there and it is difficult to separate yourself from the group, except if you have a perfect backstory or represent considerable authority in one field over another. Once more, this is the place in case you are simply beginning and endeavouring to break into the speaker scene, it will help to be somewhat more focused and explicit. As opposed to going expansive. When I originally got associated with open speaking, I began talking explicitly via web-based networking media, and explicitly for private venture development.

After some time, that sort of widened somewhat more into digital marketing system. And afterward ALL advertising policy. Also, presently it covers all features of computerized advertising, and I am ready to tailor my substance and chats on my group of spectators and their dimension of complexity or information of the point. Okay. So you have chosen what area and subject you need to specialise in to begin.

Well, query number two is…

How will you look after comprehensive brand audit on yourself?

This implies investigating all your marketing skills, like your site, your online networking channels, any of the substance you are putting out there.

What’s more, asking yourself a truly unpolished inquiry: “OK will I employ myself?”

If appropriate response’s not an unmistakable and resonating “yes!”, at that point your image is going to require somewhat of a cosmetic touch up. Since here is one thing I know to be valid.  When somebody is hoping to put resources into an open speaker, particularly to give a keynote, or something that range in hundreds of dollars for your charges, they need to ensure you are the apt individual for the activity. Which means they are unquestionably looking at your online profile. Your image’s early introduction could have a significant effect, so ensure your picture is one you really need to depict.

Moving fittingly to third query:

How to make content around your core subject?

Presently, with regards to creating content you have a wide range of alternatives:

  • you could give a grounding in a course
  • you could compose a blog
  • you could do digital recording interviews/podcast interviews
  • you could make audio-visuals

Whatever it is, the point here is to make varied amount of content. The reason you need to varied amount of content (and quality content) is on the grounds that you need to demonstrate your authority and mastery on the subject that you will be speaking. The other motivation to deliver this content is somewhat undeniable. All things considered, when somebody is making an effort to acquire the correct speaker for the activity, it makes it simpler to enlist the person who has loads of content and is plainly a specialist. Rather than taking a chance with somebody who might not know to such an extent.

That is going to move us pleasantly into fourth query.

In the former tip, we discussed making a wide range of content, however for tip four, what I truly need you to concentrate on is…

How will Audio-visual content help?

The reason audio-visual content is so significant when you need to turn into an professional and a public speaker is on the grounds is short of actually going out there and doing a public speaking for the individual who is going to appoint you. Hence, audio-visual content is the following best thing. All things considered, it enables your character to go over, your voice, your tone, what you look like, and how you lock in. I realize that a camera is not exactly an audience, yet how you present yourself on camera can regularly persist to how you are going to talk in front of an audience. It is consequently that you need to lighten any worries somebody may have in employing you by demonstrating that you are certain, expressive, articulate. And that you have got the correct style for the speech they are trying to get athwart. Fundamentally, you got to make more recordings.

That will present to all of us the best approach to query number five, which is basically…

Get out there and speak however much as could be expected…you will?

How to become a professional public speaker

In case you are simply beginning, and you are attempting to break into the speaker scene, and you need to turn into a professional public speaker, it is okay to pay your charges, and begin by completing a couple of free addresses, or if nothing else have some minor preliminary costs secured.

You don’t have to do this for long, however you do need to develop a good portfolio and get some substance out there, and some experience added to your repertoire. When you do climb into the paid positions, the amount you charge, how regularly you talk, and your style, will differ. This is all relying upon your objectives and once more, regardless of whether you need to utilize this as means of end or as the end itself. In any case, understanding that experience will do only beneficial things for your business, and your profession. And I am sure that you will agree, the level of personal development that comes along with public speaking is astral.

Gearing up…

All things considered, nothing will push your comfort level as quick as getting out there before the audience and conversing with them. These five hints truly is going to help you to be paid, and into the positions of the status of a professional public speaker.
